John SCHEID : « Le Règlement Va14-Vb7 des Tables eugubines et la tradition juridique ombrienne ».

 

Résumé

Le second règlement de la Table eugubine V est un texte normatif qui présente des points de contact significatifs avec la tradition juridique romaine. Il reprend le modèle des sénatus-consultes et des résolutions des Frères Arvales, en ceci qu’il commence par une praescriptio et qu’il est rédigé au subjonctif. Mais il contient la description d’un arbitratus qui comporte une procédure de jugement, une actio, rédigée d’une manière qui l’apparente étroitement à une formula prétorienne. Il est en effet possible de comparer la fin du texte ombrien à un type précis de formulae, celles qui portent sur un certum mais contiennent une condemnatio incerta. Aucun collège sacerdotal romain ne s’est jamais reconnu le pouvoir d’instituer une actio, ce qui ne peut se faire à Rome que dans le cadre d’une lex ou d’une formula prétorienne, et non d’un sénatus-consulte ou texte apparenté.

Abstract

The second decree of the Iguvine Table V is a normative text which shares several significant features with the Roman juridical tradition. It is structured after the model of the senatusconsults and the resolutions of the Arval Brethren, insofar as it begins with a praescriptio and it is written in the subjunctive. But it contains the description of an arbitratus, which includes a procedure of judgement, an actio, redacted in a form very similar to that of the praetorian formulae. As a matter of fact, the final section of the Umbrian text can be compared to a precise type of formulae, those which concern a certum, but contain a condemnatio incerta. No Roman college of priests has ever recognised to itself the power to institute an actio, which in Rome is only possible in the frame of a lex or a praetorian formula, and not in a senatusconsult or any similar kind of text.
